1. Agreement to Terms
These Terms and Conditions ("Terms") govern your access to and use of Our Recipe Tree, operated by Golden Pond Investments Inc ("Company", "we", "us", or "our"), accessible at app.ourrecipetree.com. By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, please do not use the platform.
2. Eligibility
You must be at least 13 years of age to use Our Recipe Tree. By using the platform, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at info@ourrecipetree.com of any unauthorised use of your account. We are not liable for any loss resulting from unauthorised use of your account.
4. Subscription Plans and Billing
Our Recipe Tree offers free and paid subscription plans. Paid plans are billed on a recurring basis (monthly or annually) through our payment processors, Stripe and PayPal. By subscribing to a paid plan, you authorise us to charge your payment method on a recurring basis until you cancel.
Plan features and pricing are subject to change. We will provide reasonable notice of any price changes. Your continued use of a paid plan after a price change constitutes your agreement to the new price.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date.
5. User Content
Our Recipe Tree allows you to create, upload, and share content including recipes, photos, videos, and written descriptions ("User Content"). You retain ownership of your User Content.
By submitting User Content, you grant Golden Pond Investments Inc a non-exclusive, worldwide, royalty-free licence to use, store, display, and reproduce your content solely for the purpose of operating and improving the platform.
You represent and warrant that your User Content:
- Does not infringe any third-party intellectual property rights.
- Does not contain unlawful, defamatory, obscene, or harmful material.
- Is accurate to the best of your knowledge.
We reserve the right to remove any User Content that violates these Terms, without notice.
6. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose or in violation of these Terms.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Upload viruses, malware, or other malicious code.
- Attempt to gain unauthorised access to any part of the platform or its related systems.
- Scrape, crawl, or use automated tools to extract content from the platform without written permission.
- Harass, abuse, or harm other users.
7. Collaborative Trees (Group Recipe Boxes)
Recipe Trees allow multiple members to contribute recipes to a shared collection. Tree owners are responsible for managing their Tree membership and the content contributed within it. By joining a Tree, you agree that your recipes may be visible to all Tree members. Tree owners may remove members or content at their discretion.
8. Recipe Books and Exports
Paid plans include the ability to generate and download printable recipe books (PDF) and digital books (ePub). You may use exported books for personal or non-commercial purposes. You are responsible for ensuring that any recipes or images you include in exported books do not infringe third-party rights. We are not liable for any content included in your exported books.
9. Intellectual Property
The Our Recipe Tree platform, including its design, features, and underlying code, is owned by Golden Pond Investments Inc and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works of the platform without our prior written consent.
10. Disclaimers
Our Recipe Tree is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components. Use of the platform is at your own risk.
Recipe content is user-generated. We do not verify the accuracy, safety, or nutritional information of recipes. Always exercise your own judgement regarding food safety, allergies, and dietary requirements.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Golden Pond Investments Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the platform, even if we have been advised of the possibility of such damages.
12. Termination
We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, if you violate these Terms or engage in conduct we determine to be harmful to the platform or other users. Upon termination, your right to use the platform will immediately cease.
13. Changes to Terms
We may modify these Terms at any time. We will post the updated Terms on this page with a revised "Last updated" date. Your continued use of the platform after any changes constitutes your acceptance of the new Terms.
14. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the jurisdiction where Golden Pond Investments Inc is incorporated.
